Property Settlement

When a marriage or de facto relationship has broken down, the Family Law Act provides the structure to identify and divide assets of the relationship that is fair and equitable.

This is a complicated area of the law. It requires the identification of the assets of the relationship, the value as provided by each person – whether they be actual financial or non-financial contributions, what are each persons needs and then whether the proposed distribution is fair and equitable.

The Property Settlement can be done without commencing any application with the court but final consent orders will be sealed by the court. Or if commenced with the court, the following time limits apply; within 12 months of the date of divorce or for de facto couples, 2 years after separation.
