Children
Children of families going through separation or divorce are within the jurisdiction of the Family Law Act.
The law regarding who children can spend time with, when and how is based around what is best for the child.
The law requires significant consideration of the issues that affect the child/children before making any order. The law also has consideration of those children that are potentially within immediate harm.
The law concerning arrangements for children is potentially complex, without the right advice. We believe in getting these arrangements agreed to without the need for attending court. This can be done by Consent Orders or Parenting Plans. Both have the advantages and disadvantages.
COST EFFECTIVE SOLUTIONS
Parenting Plans
Parenting Plans are agreements regarding children and made between each party, before commencing any Court proceeding. The Parenting Plan is then made into an Order by the Court. They become legally binding.
Mediations
If parties don’t agree, before commencing proceedings, your are obliged to attempt to mediate these matters with some professionals to help, such as solicitors or Family mediation centres.
