				<content:encoded><![CDATA[<p>The Family Law Act now allows married couples and de-facto couples (that have separated after 1 March 2009) to enter into financial agreements.</p>
<p>Financial agreements between parties can be made by couples before, during and after marriage.  These can be done via Consent Orders of the Family Court or by private arrangements.  It is best to have clear agreements attended to by lawyers and properly undertaken pursuant to the law to ensure that private agreements can be enforced by the court.</p>
<p>There are many benefits to obtaining such agreements at various stages in a marriage and provides all parties with protection.</p>

				<content:encoded><![CDATA[<p>When a marriage or de facto relationship has broken down, the Family Law Act provides the structure to identify and divide assets of the relationship that is fair and equitable.</p>
<p>This is a complicated area of the law.  It requires the identification of the assets of the relationship, the value as provided by each person – whether they be actual financial or non-financial contributions, what are each persons needs and then whether the proposed distribution is fair and equitable.</p>
<p>The Property Settlement can be done without commencing any application with the court but final consent orders will be sealed by the court.  Or if commenced with the court, the following time limits apply; within 12 months of the date of divorce or for de facto couples, 2 years after separation.</p>

<p>The law regarding who children can spend time with, when and how is based around what is best for the child.</p>
<p>The law requires significant consideration of the issues that affect the child/children before making any order. The law also has consideration of those children that are potentially within immediate harm.</p>
<p>The law concerning arrangements for children is potentially complex, without the right advice. We believe in getting these arrangements agreed to without the need for attending court. This can be done by Consent Orders or Parenting Plans. Both have the advantages and disadvantages.</p>
<p>COST EFFECTIVE SOLUTIONS</p>

<p>Parenting Plans are agreements regarding children and made between each party, before commencing any Court proceeding.  The Parenting Plan is then made into an Order by the Court.  They become legally binding.</p>

<p>If parties don&#8217;t agree, before commencing proceedings, your are obliged to attempt to mediate these matters with some professionals to help, such as solicitors or Family mediation centres.</p>

				<content:encoded><![CDATA[<p>In Australia, divorce occurs when the marriage has “irretrieveably broken down”.  No-one under the law is at fault.  You need to separated for 12 months (and under the same roof is acceptable).</p>
<p>An order of the Court will declare you divorced and it there must be no likelihood of reconciliation. It is possible for you and your spouse to be “separated under the one roof” and still satisfy the required 12 months separation.</p>
<p>You do not need to have both parties agree but there are further steps to be taken.</p>
<p>You will need to show that you have made appropriate arrangements for any children.  There is also the issue of your financial arrangements that may need to be considered.</p>
